Terms & Conditions

SAWICKYYY terms for web design and development: the 14-day project confidence promise, deposits, payments, revisions, delivery, ownership, cancellation, hosting and Scots law.

Last updated: 12 September 2026

Who you are contracting with

SAWICKYYY is the trading name of Igor Sawicki, a sole trader based at 17 Kingslaw Court, Kirkcaldy, Fife, KY1 2FH, United Kingdom. Contact hello@sawickyyy.co.uk or 07533 976180. Invoices are issued for paid services. These terms apply to web design, development, advice, domain and hosting setup, professional domain email and support.

Your quote and contract

Every project is individually quoted. Before acceptance, your written proposal sets out deliverables, total charges including any applicable taxes, payment stages, third-party costs and target dates. No contract is formed merely by browsing this website. A contract starts when both parties confirm the proposal in writing. These terms must be supplied with the proposal in a format you can save. Agreed project-specific terms take priority, subject to mandatory law.

Free consultation and quotation

The initial consultation, project scoping conversation and written quotation are provided free of charge and without obligation. Advice given at this early stage is necessarily preliminary and based on the information you provide. No production slot is reserved and no paid work begins until the proposal is accepted and any agreed deposit is received.

14-day project confidence promise

In addition to statutory rights, we offer a voluntary 14-day project confidence promise for new fixed-scope website design and development projects where the accepted proposal expressly includes it. The 14 calendar days begin on the agreed project kickoff date. To claim, you must email hello@sawickyyy.co.uk within that period, identify the material ways in which the work delivered so far does not follow the accepted brief, and provide the content, access and consolidated feedback reasonably needed to assess and correct the issue. We then have up to 10 business days, or another reasonable period agreed in writing, to bring the relevant work into line with the accepted brief. If we confirm that we cannot do so, you may end the project and receive 100% of the SAWICKYYY professional fees paid for that project. The refund ends the project and no licence or right to use rejected concepts, code or other deliverables is granted. The promise does not apply to a change of mind or preference unrelated to the brief; requests outside the agreed scope; delays, errors or omissions caused by the client; work already expressly approved; third-party products, subscriptions, licences, domains, hosting, payment processing or other non-recoverable external costs; care plans, standalone consultation, emergency work or work taken over from another supplier. It cannot be claimed after the 14-day notice period or where you prevent a reasonable opportunity to investigate and correct the stated issue. These conditions do not limit any mandatory consumer right or remedy.

Deposit and when it may be retained

The deposit is specified in your quote and is due before a production slot is confirmed or work starts. It is credited towards the project total. A deposit is not automatically non-refundable: on cancellation we may retain only the part covering work properly completed and reasonable, evidenced, unavoidable net losses caused by cancellation, without double recovery. We take reasonable steps to reduce those losses. Only that justified portion becomes non-refundable, subject to your statutory rights. Any unearned balance is returned.

Balance, invoices and late payment

Unless your written proposal sets another schedule, the remaining balance is due within seven calendar days of the final invoice, after the agreed work is made available for review and before public launch, source-code handover or transfer of ownership. Genuine defects within the agreed scope will be addressed; silence is not acceptance. Agreed milestones may be invoiced separately. If an invoice is overdue, we may pause work or withhold launch and handover after written notice and a further seven calendar days to pay. We will consider a genuine invoice dispute before suspending work. Delivery dates move by the resulting delay.

Two rounds of revisions

Unless your proposal says otherwise, a website project includes two rounds of revisions. A round is one consolidated written list of feedback on the agreed design or implementation, submitted by your nominated decision-maker. A revision adjusts existing work within the approved brief, such as colour, spacing, typography or replacing supplied text. Correcting our errors or failures to meet the agreed scope does not use a revision round.

Revisions versus additional work

A new page, new feature, integration, booking system, ecommerce flow, major layout change after approval or change of audience or strategy is additional scope, not a revision. Extra revision rounds and scope changes require a written quote and your approval before paid work starts. We will explain any effect on delivery dates.

Timelines and 21 days without a response

Target dates depend on timely content, access, decisions and feedback from you. We will explain material changes to the schedule. If you do not respond for 21 consecutive calendar days after a request needed to continue work, we may mark the project paused and notify you by email. Restart is scheduled according to availability, with any genuinely necessary new costs agreed first. There is no automatic restart fee or forfeiture of your deposit. If the pause continues, we may close the project after a further 14 days of written notice and apply the fair cancellation settlement below.

Content, photographs, logos and permissions

You supply and approve accurate text, photographs, logos, trademarks and other materials unless creation or licensing is expressly included. You must own them or obtain the necessary permissions and tell us about licence restrictions. You are responsible for the legality and accuracy of your business claims and supplied content. We are responsible for obtaining appropriate rights for materials we supply and will identify third-party licence conditions. Do not send passwords in ordinary email; use an agreed secure access method.

Ownership after full payment

Once all agreed project payments are received, ownership of the final bespoke design and code created specifically for you transfers to you, to the extent those rights are owned by SAWICKYYY. You retain ownership of your own content throughout. Pre-existing tools, reusable components, methods and open-source or third-party assets are excluded from that transfer. You receive a continuing licence to use our incorporated pre-existing materials as needed to run, maintain and modify the delivered website; third-party licences continue to apply. The agreed source files and account access are handed over after payment.

Portfolio permission and confidentiality

We may display the completed, publicly launched website, screenshots and your business name in our portfolio and professional marketing. Tell us before work begins if the project must remain confidential; a written confidentiality agreement or portfolio opt-out takes priority. We will not publish private account details, customer data or unpublished confidential material.

Domains, hosting and professional email

Domain registrations, hosting and professional email subscriptions are separate third-party services unless expressly included. Where practical, accounts are registered in your name and you retain control. The proposal identifies who pays subscriptions and handles renewals. Email setup can include mailboxes, DNS, MX, SPF, DKIM and DMARC as supported by the selected provider. Migration, ongoing mailbox administration and deliverability monitoring require agreement. Provider outages, policy changes and spam-filter decisions are outside our control; we remain responsible for performing our agreed configuration work with reasonable care and skill.

Backups, maintenance and handover

Unless a care agreement expressly includes them, ongoing backups, restoration, updates, monitoring, security maintenance, domain renewals and hosting administration are your responsibility after handover. We will explain the agreed handover and backup arrangements. A maintenance agreement must specify coverage, backup frequency, retention, restore procedure and response expectations. A website build alone does not include indefinite support or guaranteed recovery from data loss.

Cancellation and project closure

The voluntary project confidence promise, statutory consumer cancellation rights and ordinary project cancellation are separate routes. Outside a valid promise or statutory claim, either party may request cancellation in writing. On client cancellation we calculate completed work and reasonable unavoidable net commitments, deduct payments already received and refund any excess. We provide an itemised explanation and do not charge for avoidable future work or recover the same loss twice. If we cancel without your breach, unperformed prepaid work is refunded and paid-for usable deliverables are handed over. For a material breach, the other party normally receives 14 days to remedy it before termination, except where immediate action is reasonably necessary for unlawful activity or serious security risk.

Consumer cooling-off rights and refunds

If you buy mainly outside your trade or profession as a consumer under an eligible distance service contract, you normally have 14 days after the contract is concluded to cancel. Email hello@sawickyyy.co.uk or write to our address with a clear cancellation statement. Work begins during this period only at your express request. If you then cancel, any lawful deduction is proportionate to services supplied up to cancellation. Your cancellation right ends on full performance only with the required prior express consent and acknowledgement. For statutory cancellation, refunds are made within 14 days of notice using the original payment method unless otherwise agreed, without a refund fee. Other agreed refunds are normally processed within 14 days of settlement. Your remedies for defective services are unaffected.

Optional cancellation notice

To Igor Sawicki trading as SAWICKYYY, 17 Kingslaw Court, Kirkcaldy, Fife, KY1 2FH, United Kingdom; hello@sawickyyy.co.uk. I give notice that I cancel my contract for the following service: [service]. Contract date: [date]. Consumer name: [name]. Consumer address: [address]. Date: [date]. Signature: [only if sent on paper]. You do not have to use this wording.

Quality, SEO and commercial results

We perform agreed services with reasonable care and skill. Report defects so we can investigate and provide the remedies required by law, including repeat performance or an appropriate price reduction where applicable. We build for speed, clear structure and technical SEO, but cannot guarantee a particular Google position, search traffic, performance-test score, email inbox placement, conversion rate or sales increase. Results depend on competition, content, hosting, third-party code and ongoing changes.

Limits of liability

Nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or rights and liabilities that cannot lawfully be restricted. Consumers retain liability protection for reasonably foreseeable loss caused by our breach and all mandatory statutory remedies. For business clients only, subject to those exclusions, aggregate liability for a project is capped at the total fees payable for that project; indirect or consequential losses and loss of profit or business opportunity are excluded. Neither party is responsible for delays beyond reasonable control, but must notify the other and take reasonable steps to reduce the impact.

Scots law and resolving concerns

These terms and the contract are governed by Scots law. Contact us first so we can try to resolve a concern. Scottish courts have jurisdiction for business disputes. Consumers retain mandatory protections and any right to use the courts of their home jurisdiction. Changes to these website terms apply to future contracts; existing contracts change only by agreement.
